Jai-Alai: ¿juego limpio?

As I said in the previous post, this year in May had the chance of photographing, with photographer Romy Fernandez Arroyo, an exhibition of jai-alai. Without doubt a great experience and I want to repeat, photographic opportunities offered by this sport are huge!
I also talked with the event organizers, Bilbao Jai-Alai, that showed much interest in seeing our photos. So a few days later we show them on my website and fell apart in praise to our work. And they liked it so much that they used some of these photographs without our permission or knowledge to advertise another event that was organized by them and could by seen, payment of 5 €, in September in Plentzia (near Bilbao).
And now, the “proofs“…

For the poster announcing the event and advertising leaflets:

it was manipulated (with questionable taste) the photography:

This photograph was also used, this time without any manipulation for elabaoración of black and white leaflets (photocopies). And to prepare the promotional leaflet:

addition to the previous picture (on the other side of the diptych) they also took the photographs:

I happende we went to Bilbao in the same weekend that they celebrated the spectacle of Plentzia and we could amazed observe how the city (or at least the old town which is where we were) was full of these posters, dyptichs and leaflets.

We tried to contact them to clarify this issue, but two months later we are still awaiting a response… A performance that can blacken the name of a sport so beautiful.

The dissemination of photographs on the Internet is a double edged sword. On the one hand allow fans to show their work to others, on the other t you are up for grabs, and sadly, abuse photographs lightly skipping rights that protect them (Intellectual Property Law, LPI) is too common.

Hoygan the avenger, that monkey is that of “HAVER”.

  • What they've done pretty ugly, especially after you show them pictures and tell you they liked, have used them, but at least have bothered to apply the “cuarteado” (think that is the filter that have used photoshop), I do not like to use the photo as is or rename one color or cut it but it is wrong tb. a greeting and to get paid something or you receive a reward, is the least we should do. greetings

  • I will denounce, directly

  • Walker

Also in this …ahem “designer” podirias you recommend any art school, or even a Photoshop Cursito inem, that could not be more sad work…
A greeting and good luck with the contest.

Why not tell the whole story? I got in touch with them since I hurt it gets dirty the name of the Basque ball and read the mail you sent them by giving permission to use photos, and as he was hired to Plentzia you're doing campaign against. Be careful because this story can turn against you as you hang the mail or denounce damaging the honor of a sports club.

  • The news came the day 9 en meneame.net and provoked an interesting debate on intellectual property in the photograph, and some comments on this post. We would like to thank all those comments, both those who support as those in a respectful way enrich us with other opinions and viewpoints.

The only intention was to expose what happened and stick to what the picture on that is what this blog is, and so, as noted in medem “not the whole story”. But before your comment on this blog and medea in meneame.net we have to clarify some things. For those who have not read the last comment I copy here verbatim:

“The Devata has raised this issue I feel very good and interesting but I want to clarify that the ceded ARRONDO HERNANDEZ SR.RICHARD photos for free and will send it WHO WANTS THE MAILS SHOW THAT IF. Happened then was not hired for the event in Plentzia tacky and this is his revenge.
This is a preview of the mails:
    Hi mate!
I passed the links on our pages: Here we go up these days some photos, but we have a few more, so when you just processed and an address where we will be able to download.
    greetings!
    Richard
BEWARE THIS PHOTOGRAPHER MAKES YOU THE PICTURES AND THEN GIVE YOU THE MONEY YOU NEED.
ALL pelotaris we witnessed this and we are very angry.
EL CLUB NOS PIDE TRANQUILIDAD PERO LOS PELOTARIS CREEMOS DEBE ENMENDAR EL BUEN NOMBRE DEL CLUB O ATENERSE A LAS CONSECUENCIAS.”

After taking pictures of the spectacle in Pamplona talked with officials of the event and we agreed verbal free pass on these photos and do a job with them the next time. Under the framework of this agreement we will facilitate the photos, and allow use with the proviso that when used should be credited to the photographers who took them. We would like to emphasize that during this conversation any of pelota was there, so I do not understand how they can witness more than that we were taking pictures. For some months we exchanged several emails in preparation for the work that would develop in Plentzia, but finally decided to do without us and hire other photographers, thus breaking our verbal agreement and thus ending with the permission to use photographs taken in Pamplona.

Days later and with amazement saw in Internet posters and leaflets advertising this event Plentzia prepared from our photos. At no time told us they intended to use, and also not credited our authoring (our name does not appear anywhere). We understood that they did this in bad faith, so we contacted them with the intention of resolving this amicably. However, after almost two months since our last email we have not had any news about them. It was this that encouraged us to write a blog post (described as “shabby revenge” by medea) and not the fact that we were not hired. The reason was the use of the photos to promote this same event, stress, and beyond our verbal agreement. That's why we said in the blog “they used some of these photographs without our permission or knowledge”.

Our only goal was not to speak of a proper use of our photos and if at any moment this could besmirch the name of the club or jai alai, We ask our sincere apologies. Indeed, we encourage them all to alleviate this type of event, because we found very interesting.

Now I, we would like to point out some things on the commentary on meneame.net medea. Accusations like “BEWARE THIS PHOTOGRAPHER MAKES YOU THE PICTURES AND THEN GIVE YOU THE MONEY YOU NEED” or comments as “Pelotaris BELIEVE THE GOOD NAME TO AMEND THE CLUB OR ABIDE BY THE CONSEQUENCES” seem distasteful and completely out of place. If anyone wants more information can ask of medea, because we believe that the emails exchanged are something private and not to disseminate “who want”.

  • Denunciales. Do not hesitate. It won the case and you can claim compensation, priced based on the number of posters, folders and leaflets have been printed.

The remuneration to be received by this is much higher than you would have received in advance buy photos (this is done because otherwise, all these sausages “fusilarían” Photos around: if they caught the pay, and if they do not get caught, do not pay. To avoid this, what is done is fairly penalize).

seriously, do not let chule… arrogance is a bad thing, and these people have been very arrogant over pasandote.

Sounds like a nerve which has made this club, but I disagree with you on one thing Richard, e-mail like any postcard from the moment that sent, ceases to be yours. It is the recipient and can therefore dispose of it.

Furthermore, what to expect consequences, certainly sounds very ugly.

Mood and if you decide to sue has my support.

  • I see many brave unaware of what happened and just stick with the photographer by the mere fact of belonging to the guild, corporate solidarity and not real because, as I said at the beginning, are not known all the details of what happened.
the reality is that there was a show in pamplona pelotistico and were invited to enter the grounds and take pictures when the image rights belonged to the company organizing the event, which incidentally has nothing to do with Jai Alai Bialbao which is what is eating up all the brown.
Once given away the images that this photographer working accounted for giving us your e-mail with a certifying, accepted as proof, So yes, please asking that we put your link on photos, thing we've done in your day on page ww.euskaljaialai.com. These photos, once transferred to the owners of the rights of image, contact with the photographer decided to cover another event in September at plentzia but accidentally did not reply to one month in advance to our requirements to which we had to find another professional life. It is for these reasons that, professionals ask guild, before evaluating a subject, become informed by both sides and leave the coorporativismo aside because in this case the photographer in question is insulted at a club that has nothing to do with what happened because they used some photos previously released by the photographer (in your day with good faith) image to their owners, Company
    organizing.
No more a salute to the forum and we will contact as these injuries to this club are not receiving

EYE!, is not the same download a song, a game / program. I'm not a no-versed in the subject, but that with the programs and games, Shopping is what licenses, hence the serial num, to use the product exclusively in one or more computers (depending on the type of license).
So referring to precisamnete game or OS and not a cd or song, although there poruqe profit, download and use is illegal.
Although this does not mean that either cost them both to put the club somewhere on the author's nom respect or gratitude. Only that, greetings.
